After weeks of investigation, the Potter County Grand Jury has decided not to file charges in connection with a fatal shooting that occurred at Olson Park on June 25, 2025. The decision was announced Wednesday following a joint presentation of the case by the Amarillo Police Department (APD) and the Potter County District Attorney’s Office.
The incident unfolded just after midnight at approximately 12:08 a.m., when APD officers were dispatched to Olson Park in response to reports of a shooting. Emergency responders from AMR and the Amarillo Fire Department joined officers at the scene and attempted life-saving measures on 22-year-old Braydon Mitchell Ellertson, who was ultimately pronounced dead on site.
According to authorities, the individual who called 911 reported being approached by Ellertson at the park. A physical altercation allegedly broke out between the two men, during which the caller fired a single shot from a firearm, striking Ellertson. Homicide detectives responded to the scene and immediately launched an investigation. At the time, no arrests were made, and Ellertson’s family was notified.
On July 23, the case was formally brought before the Grand Jury. After a thorough review, jurors issued a “no bill” regarding John Tiernan, the individual involved in the shooting. A “no bill” means the Grand Jury found insufficient evidence to support criminal charges.
“The Grand Jury’s role is to review evidence and determine if there is enough information to pursue criminal charges,” officials stated. They emphasized that the process is designed to allow for a fair and impartial assessment of the evidence presented.
The APD acknowledged the difficulty and sensitivity of the case, particularly in light of its impact on the community.
“The Amarillo Police Department remains committed to transparency and the pursuit of justice. We acknowledge the complexity of this matter and the impact that such decisions have on the community. The APD and the Potter County District Attorney’s Office will continue to work diligently to ensure that all cases are investigated thoroughly and resolved in accordance with the law,” a statement from the department read.
Law enforcement officials reiterated their commitment to handling all cases with care, emphasizing the importance of a judicial process grounded in fairness, evidence, and due diligence.
